NightWave Terms of Service

1. Acceptance
By downloading, installing, or using NightWave (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
2. Description of service
NightWave is a sleep and relaxation sound mixer. You may play, mix, and save combinations of ambient sounds, use timers, playlists, and optional premium features. The App is for personal, non-commercial entertainment and wellness support only.
3. Not medical advice
NightWave is not a medical device and does not provide medical, therapeutic, or professional health advice. Do not use the App as a substitute for professional care. If you have sleep disorders or health concerns, consult a qualified provider.
4. Accounts
You may sign in with Google. You are responsible for activity on your account and for keeping your device secure. We may suspend access if you violate these Terms.
5. Subscriptions and purchases
Premium features may be offered through Google Play Billing, including:
- Monthly Premium — auto-renewing subscription
- Annual Premium — auto-renewing subscription
- Remove Ads Lifetime — one-time purchase (ads removed; premium sounds may still require a subscription)
Prices are shown in the App and at checkout. Payment is processed by Google Play under Google Play Terms of Service. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period. Manage or cancel subscriptions in your Google Play account settings.
Refunds are handled according to Google Play policies. Use Restore purchases in the App after reinstalling on the same Google account.
6. Ads
The free version may display ads (e.g., Google AdMob). Optional rewarded ads may unlock limited premium content until local midnight. Ad-free access is included with applicable Premium or Remove Ads purchases.
7. License and intellectual property
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use. Sound assets, software, branding, and content in the App are owned by us or our licensors and are protected by copyright and other laws. You may not copy, redistribute, resell, reverse engineer, or extract audio or code except as allowed by law.
8. Acceptable use
You agree not to:
- Use the App unlawfully or to harm others
- Attempt to bypass paywalls, licensing, or security
- Abuse purchases, refunds, or promotional offers
- Interfere with servers, ads, or other users’ experience
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISTALYTIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
11. Changes
We may update the App or these Terms. Material changes will be reflected by updating the “Last updated” date and, where appropriate, notice in the App. Continued use after changes constitutes acceptance.
12. Termination
You may stop using the App at any time. We may suspend or terminate access if you breach these Terms or for operational reasons. Sections that by nature should survive (disclaimers, liability, governing law) will survive termination.
13. Governing law
These Terms are governed by the laws applicable to Vistalytix’s place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
